unhappy ebayer...

I sold a mark viii climate control center awhile back. I just got a email from the buyer..

When I installed this control panel, I found that four of the five general illumination bulbs were bad. The only ones I could find are $18 each plus tax. I did not buy the bulbs because this would make this item too expensive. I would like to return it for full credit including the 5% override. Please advise.

He wants a refund because the bulbs dont work. It worked when I pulled it like stated. I told him that the item was sold AS-IS which relieves me of reliablity. Anyone think he's gunna try to screw me more?

Dude, how the heck do to those bulbs cost $18?? Anyway, as far as liability, you're in the clear. Now, that said, he'll probably give you negative feedback if you don't take it back. It's really up to you.

Here is what I would offer:

Have him send it back. When you recieve it, send him another one if he pays all the shipping to and from. If they lights are in fact bad, I would probably offer to refund the "second" shipping costs. Granted you're eating the first price, but you could probably sell it again just list the lights as bad.

IMHO, "As-is" = As is... no refunds.

Just my .02 and it all depends on how improtant a negative feedback is worth.

Personally I would tell him you said as-is and you are not responsible for a bulb being out. Tell him to either fix it or he can re-sell it.

Couple of things:

1.)I was always under the impression that "as-is" meant exactly that . . . as-is. Buyer beware.

2.)How in Hades are lightbulbs costing $18 each? The lightbulbs for mine are in the area of a buck a piece.

he bought it over 20 days ago and now said somthing. Where can I get bulbs for that cheap so he leave me alone

I just contaced ebay and let them know everything that is going on. I dont want to screw him over but I dont have the money to refund.

I wouldn't refund the money. Who knows if he took the bulbs and now wants to send the unit back to you. That would be like saving the money.

AS-IS is just that.

i'm with this guy, the bulbs are prolly just low on halogen fluid. tell him to try to refill them, maybe then they'll work.
on the reals though, if those general ill bulbs are out you can get them at napa for a buck a piece if they are the ones that look like miniature 194 bulbs.

Where as an as-is waiver releases the seller from any warranty whether expressed or implied, it would be beneficial to use an actual as-is clause. I work at a law firm in the real estate department and I manage a title company and depending on the situation, different clauses can be used to specify the release.

That being said, ebay is an all together different matter and often the extra cost or burden is forced upon the seller in lue of the fear of negative feedback, which we all know will possibly be a detriment to future sales. Although it does not appear that you are required to honor his request, I would suggest that you contemplate what your long term plans are. If indeed you can buy 4 new bulbs at $1/bulb, it may be more beneficial to supply those than risk losing potential business.

If you approach the buyer with the idea of replacing the bulbs, it may also help to shed light on the entire situation. If the bulbs are in fact the problem, he has no reason to be hesitant. However if he ordered the wrong part, or as previously mentioned, it didn’t fix his problem, than he may try to avoid the compromise. Regardless, $4 is less than refunding the $61 plus shipping as he requested.

Awsome point. That is what I would go with after thinking about the whole negative feeback issue. I have 330 positives and 0 Negatives; I'd wanna keep it like that....lol

I'd say tell him politely that you ain't f'in Wal Mart, as is means no refunds and no returns. If he even bothers to leave negative feedback (which he may not based on some cell phone deals I did) email eBay to have it removed as unjustified, especially if you sold it for a lot less than the Ford price. If you accurately represented it then you shouldn't have to worry about negative.

You only need two tools: WD-40 and Duct Tape. If it doesn't move and should, use the WD-40. If it shouldn't move and does, use the duct tape.

On ebay AS-IS means AS-IS...I'd politely point out to him the auction terms and state that the item worked when tested and was accurately described, sorry but I don't know what happened to it, but no refunds. The terms were clearly as-is...

if he left a neg I'd just reply to it "item was accurately descibed, clearly sold as-is, no refund!

it depends on how important your ebay account is to you, if you are not that established and can start again tell the guy tuff luck, wait and see what he does, i wouldnt refund him because you put in the auction that its as-is
